FIELDS OF APPLICATION

The General Terms and Conditions of Sale (GTCS) apply to all KYMASTONES sales (physical goods, services and online training), concluded remotely (website, telephone, e-mail), in the showroom or at trade fairs; but also advice, free content, and gifts offered. The version in force at the time of the order is authoritative.
PRICES, SPECIAL OFFERS AND DELIVERY RATES
Basic prices are quoted in Swiss francs (CHF), including 8.1% Swiss VAT.
Prices can be automatically converted into the buyer’s currency (depending on the browser used), according to the exchange rate in force at the time of purchase, but always including Swiss VAT.
Price changes do not affect orders that have already been validated. Any taxes and formalities outside Switzerland (customs, import VAT, etc.) are the direct responsibility of the customer.
TERMS AND CONDITIONS OF DELIVERY AND COLLECTION
Delivery times are indicative. In the event of unavailability of a product or unforeseen delay, the customer will be informed promptly.
KYMASTONES accepts no responsibility for delays not attributable to its fault. Partial deliveries will only be made with the agreement of the customer.
Deliveries of bulky and valuable goods are secured by delivery against signature, or by hand only.
RIGHT OF WITHDRAWAL AND EXCHANGE
Customers may exercise their right of withdrawal within 7 clear days, without justification or penalty. After notification of withdrawal within 7 days, the customer has 14 days to return the products to the address indicated, at their own expense.
Products must be returned in new condition, complete and in their original packaging.
The refund (price of the product and standard delivery costs) will be made within 14 days of receipt of the returned product. In the event of the return of a damaged or incomplete product, a discount corresponding to the loss of value may be applied.
Online training courses that have already begun (accessible courses) will not be reimbursed, except in the event of a persistent technical fault attributable to KYMASTONES.
LIABILITY AND WARRANTY
The products benefit from a 2-year guarantee against material defects, in accordance with art. 210 of the Swiss Code of Obligations (CO). The customer must report any defects without delay. Natural differences in colour and shape do not constitute defects. KYMASTONES’ liability is limited to direct damage resulting from a proven fault, excluding indirect damage.
The stones, minerals and formations sold or mentioned on the KYMASTONES website do not claim to have any medical, therapeutic or health effect. Under no circumstances do they replace professional medical advice, diagnosis or treatment. The use of the products offered is the sole responsibility of the user. KYMASTONES declines all responsibility in the event of misuse, handling error or consequences resulting from non-compliant use of the stones, particularly with regard to the physical or psychological health of the user. In case of doubt, it is the user’s responsibility to consult an appropriate health professional. By accepting these GTC, the purchaser acknowledges having been informed of these limitations.
PAYMENT
Payment is due when the order is placed. The following are accepted: bank cards, Paypal, Google Pay, Twint, and payment in cash at the showroom by appointment.
Invoices must be received within 10 days, after which a reminder fee and interest on arrears of 5% are due.
The goods remain the property of KYMASTONES until full payment has been received (reservation of ownership clause).
INTELLECTUAL PROPERTY
All content, training materials, texts, images, videos, software, as well as graphic elements and designs present on the KYMASTONES site are protected by copyright and legislation relating to intellectual property, belonging to KYMASTONES or its partners.
The customer benefits from a strictly personal, non-exclusive, non-transferable right of use limited to private use. Any reproduction, representation, modification, distribution, adaptation, translation, or provision to third parties, whether partial or total, is strictly forbidden without the prior written authorisation of KYMASTONES.
Visitors to the site may consult, download or print certain information for personal use only, depending on the possibilities offered by the site. Any commercial use or other exploitation of the content without prior agreement constitutes an infringement of intellectual property rights and exposes its author to legal proceedings.
DATA PROTECTION & Privacy Policy
KYMASTONES is committed to respecting European regulations on the protection of personal data (RGPD) as well as Swiss legislation (LPD revised 2023). As such, personal data collected when ordering or browsing the site is processed in a lawful, fair and transparent manner.
The purposes for which data is collected include: order management, invoicing, customer service, managing access to online training courses, sending information about services and products, and complying with legal obligations.
The personal data collected may include: surname, first name, address, e-mail address, telephone number, payment information and browsing data.
The user’s consent is required for the processing of data not strictly necessary for the order, in particular for marketing, advertising or analysis cookies. Users may withdraw their consent at any time.
Data is kept for the time required to process the order and in accordance with legal obligations, then archived or deleted in accordance with the applicable rules.
In accordance with the RGPD, the user has the following rights at all times: access, rectification, deletion, limitation of processing, portability, opposition, and the right to lodge a complaint with a data protection authority.

In the event of data being transferred to countries outside the European Union, KYMASTONES ensures that the appropriate legal guarantees are respected.

APPLICABLE LAW AND PLACE OF JURISDICTION
These GTC are governed by Swiss law. The place of jurisdiction is the seller’s registered office, i.e. the district court of the east of Vaud in Vevey, Switzerland; subject to the imperative rights of the consumer (place of jurisdiction at his place of residence).
